Advising the Elderly
People who are nearing retirement, or who have already
retired, often have particular legal issues to face.
They should of course make or consider reviewing their
Wills. However, they may be concerned about paying for
their care should they have to move into a Residential
or Nursing Home. They may wish to try and preserve assets
to pass on to their family.
In addition, they should also consider appointing someone
(an "Attorney") to look after their financial
affairs, particularly should they become mentally incapable.
This can be done by signing an "Enduring Power
of Attorney". We can advise on whom to appoint
as an Attorney and on what powers should be given.
It is important to realise that an Enduring Power of
Attorney has to be signed before a person becomes mentally
incapable. Once mental incapacity has set in, the only
way of dealing with a person's financial affairs may
be by the appointment of a Receiver by the Court of
Protection. We can deal with applications to the Court
and assist in the management of the person's affairs
after an appointment is made.
