Personal Injury - FAQ's

Personal Injury - Frequently Asked Questions

Q. How much can I claim ?
A. The amount you can claim will depend upon the extent of your injuries. This will normally be assessed by obtaining a report from a medical expert who will look at the injury itself, the effects it has had upon you and your everyday life, and whether those effects are likely to continue into the future. You can also claim for financial losses which have resulted directly from your injury.

Q. How long will it take ?
A. The length of a claim varies from case to case. A very straightforward claim arising from a road traffic accident can be resolved in a minimum of six months. Most claims can take several years. It often depends upon the nature of your injuries. It is important not to settle a claim until the full extent of your injuries is known, as if your condition worsens after your claim has settled you cannot ask for more compensation. Also, the length of time involved can also depend upon the attitude taken by the person who injured you, whether they are prepared to admit liability or want to argue about this, and whether they are prepared to make a reasonable offer of settlement. The Solicitor dealing with your claim will give you an estimate of the timescale involved at the outset and keep you updated if this changes as your claim progresses.

Q. How do I pay for a Solicitor ?
A. If you have a household or motor insurance policy which includes legal expenses insurance, then your insurers may cover your legal costs for a Personal Injury claim. It is important to check this at the start. Usually, however, the best way to fund your claim is on a no-win, no-fee basis. If your claim is not successful you do not pay your Solicitors charges. You may however have to pay disbursements, but your Solicitor will explain this to you before you decide whether to proceed. If you win your claim, then the costs should be recoverable from the person who caused your injury.

Q. I notice your Personal injury team are based in Liverpool City Centre, but I don't want to have to travel into the City. Can I see someone in your Woolton or Crosby offices ?
A. Yes you can. Members of our team will come to see you at either of our branches, or, if your injuries mean you are unable to travel, then we may be able to arrange to visit you at your home. Your claim will be handled from the City Centre office, but all appointments can be arranged in one of our branch offices if this is easier for you.
